General Terms and Conditions of Use for the Creadigme SaaS Service
1. Definitions
"The Company" refers to the company CREADIGME SAS, a French SAS.
"The Service" refers to the Creadigme SaaS service accessible by subscription.
"Customer" refers to any individual or legal entity that has subscribed to the Service.
"User" refers to anyone who uses the Service, whether they are a customer or a person invited by a customer.
2. Purpose
These General Terms and Conditions of Use (GTC) aim to define the conditions under which Users can access and use the Service.
3. Acceptance of GTC
Access to and use of the Service are subject to the acceptance and compliance with these GTC. By accessing or using the Service, the User agrees to comply with these GTC.
4. Intellectual Property
The Company holds the intellectual property rights relating to the Service, excluding illustrations from the unDraw site (https://undraw.co/). Any unauthorized reproduction, representation, modification, publication, transmission, denaturation or exploitation of the Service, in whole or in part, is strictly prohibited.
5. License to Use the Service
The Company grants the User, for the duration of their subscription, a non-exclusive, non-transferable, and non-sublicensable license to use the Service, for their own needs and for the number of users authorized by the subscribed subscription.
6. Use of the Service
6.1. Users agree to use the Service in accordance with these GTC, applicable laws, and rules established by the Company. Users also agree not to use the Service for illegal purposes or in violation of these GTC.
6.2. Users are responsible for their use of the Service and agree not to infringe the intellectual property rights of the Company or third parties. Users also agree not to use the Service to harass, threaten or harm others.
7. Fair Use
7.1. The Company is committed to providing quality service to all Users. In order to preserve the integrity of the Service, the Company reserves the right to take measures, including suspension or termination of access to the Service, in case of abusive or excessive use of the Service by a User or a group of Users, which could harm the performance and quality of the Service for other Users.
7.2. Normal and reasonable use of the services by Users is generally not considered abusive or excessive. However, the Company reserves the right to determine, at its sole discretion, whether a specific use of the Service constitutes a violation of this fair use policy.
8. Access to the Service
8.1. The Service is accessible to Users via a username and password. Users are responsible for the confidentiality and use of their usernames and passwords. Customers are also responsible for any activity related to the use of the Service by their Users. The Company cannot be held responsible for any loss or damage resulting from unauthorized use of Users' usernames and passwords.
8.2. The Company implements the necessary technical and organizational measures to ensure the availability and security of the Service. However, the Company cannot guarantee absolute availability and security of the Service and cannot be held responsible for any interruption or malfunction of the Service, regardless of the causes.
8.3. The Service is compatible with Google Chrome, Mozilla Firefox, Microsoft Edge, Opera, and Safari browsers released in the last two years. Although these browsers are explicitly supported, other more recent browsers may also be compatible. However, the use of unsupported browsers or versions may affect the performance of our Service. Please note that the list of supported browsers can be modified at our discretion.
9. Personal Data
The processing of Users' personal data is subject to the Company's Privacy Policy, available at https://creadigme.net/en/privacy-policy/.
10. Cookies
The Company's website uses cookies to improve user experience and to compile visit statistics. The cookie policy is available at https://creadigme.net/en/cookies/.
11. Technical assistance and customer support
The Company undertakes to provide technical assistance and customer support to Clients within 48 hours of receiving their request.
12. Maintenance and software updates
The Company commits to regularly updating the Service in order to improve its quality and performance. The Company reserves the right to carry out maintenance operations, during which access to the Service may be temporarily suspended. The Company will inform the Client of these operations as far as possible.
13. Backup and data recovery
The Company commits to implementing backup and data recovery measures for Client data hosted as part of the Service. However, the Client is responsible for backing up their own data and is advised to regularly perform backups on their own systems.
14. Force majeure
The Company cannot be held responsible for any failure to fulfill its obligations under these Terms of Use in the event of force majeure, as defined by French case law.
15. Liability in case of service interruption
The Company cannot be held responsible for any interruption of the Service due to circumstances beyond its control, including, without limitation, hardware, software, or network failures.
16. Integrations and interoperability with third-party services
The Service may integrate and interact with third-party services. The Company cannot be held responsible for the availability, quality, or operation of these third-party services, nor for any damages or data loss related to their use.
17. Subscription termination
The Client may terminate their subscription at any time from their dashboard. The cancellation will take effect at the end of the current commitment period.
18. Service Level Agreement (SLA)
The Company commits to implementing all necessary means to ensure the continuity and quality of the Service, with a 99% SLA. However, the Company cannot be held responsible for temporary interruptions of the Service due to causes beyond its control.
19. Changes to the Terms of Use
The Company reserves the right to modify these Terms of Use at any time. The changes will take effect upon their publication on the Company's website.
20. Applicable law and competent jurisdiction
These Terms of Use are subject to French law. Any dispute relating to their interpretation and/or execution falls within the jurisdiction of the competent French courts.
